Viewing cybersecurity as a merely technical task is far too simplistic. Its legal and compliance aspects have now become almost as complex as the technology itself and they are currently advancing rapidly at German, European and international level.

Keywords in this regard are the General Data Protection Regulation of the European Union, the IT Security Act and its planned further development, the Cloud Act in the United States, the European Digital Single Market and the new regulations that the big economies of Russia and China are constantly adopting. Overall countries are now regulating data traffic and the internet much more closely.

We cannot now escape the conclusion that it is not only Distributed Denial of Service (DDOS) attacks or complex attacks that may threaten the existence of particular companies, but also non-compliance with the increasing number of cybersecurity laws and sector rules. For instance, in the event of non-compliance with the GDPR, penalties of up to 4 percent of worldwide corporate revenue could be levied.

This increasing regulation and the dramatic penalties have brought cybersecurity and data protection into the focus of management teams and executive boards, for at the end of the day they will be held responsible for misconduct.

In order to be able to provide them with appropriate advice, lawyers and advisers must be constantly equipping themselves with knowledge and training regarding cybersecurity rules and regulations.
